Contract and Warranty

1.            Agreement: This is a contract for painting services as described on the proposal. By signing this document and the proposal, you have entered into a legally binding agreement. Any modification to the services described shall be ineffective unless a change order is completed and signed by both parties.

2.            Cancellation. You may cancel this Agreement without penalty or obligation up to seven (7) days after entering into it. Cancellations received after seven (7) days will be subject to a liquidated damages assessment of twenty percent (20%) of the contract amount. In the event of cancellation after non-returnable supplies have been purchased, you will be assessed the cost of said supplies, in addition to any liquidated damages. In the event of cancellation, you must make available to us any supplies or equipment delivered to the job site in substantially the same condition as delivered. Cancellations are effective when delivered by certified mail, return receipt requested, or by other delivery service which receipt for delivery is provided.

3.            Unforeseen Conditions. In the event any conditions arise which could not be determined by visual inspection prior to starting work, you will be notified of the unforeseen condition and any additional charges which may required to perform the work. Any such modifications will be noted on a change order. The visual inspection will be based upon reasonable and customary trade practices.

4.            Modifications. Any modification to the work described on the proposal, including paint color, must be agreed to by both parties and annotated on a change order. There may be an additional charge for such modifications. If a color change is requested after the job starts but not completed, we will charge for time and material expenses incurred on the original color. Time will be charged at $52.00 per man per hour.

5.            Payment. Payment is due promptly upon completion of the job, or within ten (10) days after receipt of an invoice for untimely cancellation. In the event we must resort to legal action to enforce this contract, you are responsible for our reasonable attorney’s fees, court costs, collection fees, and interest (18% annualized-interest on unpaid balances will begin from the completion date) in addition to any amounts due under the contract.

6.            Two (2) Year Limited Warranty. For a period of twenty-four (24) months following the completion date, Vision Painting, Inc., guarantees its work against excessive chipping, peeling or blistering of paint resulting from defective product or workmanship. Finishes are guaranteed to be in compliance with industry standards. We will perform any covered repairs at no cost for labor or materials to the original customer listed on the contract (if property has been sold, the new homeowner will be covered under this warranty for the full two years from the original completion date) to the level of the surface preparation originally specified on the contract, and only on the specific areas where the peeling, blistering or chipping has occurred. 

THIS WARRANTY DOES NOT COVER THE FOLLOWING: (1) Caulking; (2) Wooden gutters, painted or stained roofs; (3) Lap marks; (4) Horizontal surfaces, including but not limited to deck floors, railings, stairs, porches, window sills; (5) Bleeding knot holes, rust stains or cedar bleed; (6) Failure due to structural or design defects of the house; (7) Failure due to moisture damage; (8) Varnished surfaces (i.e.: front doors); (9) Normal fading or chalking of paint; (10) Mildew or other environmental conditions; (11) Rotting wood; (12) Galvanized metal surfaces; (13) Peeling of previous paint layers; (14) Customer-supplied paint surfaces; (15) Stucco cracking; (16) Masonite Siding, LP Siding (or similar product) and EFIS  is not covered under the warranty only if stated in Prepainting Conditions as in poor condition.

This warranty is the only warranty made by Vision Painting, Inc., and all other warranties, express or implied, are hereby disclaimed. No repairs under this warranty will be made to peeling, chipping or blistering due to surfaces or conditions expressly excluded above. This warranty is limited to repainting only, and Vision Painting, Inc., expressly disclaims any and all liability for and shall not be liable for any incidental or consequential damages resulting from a breach of this warranty.



To make a claim under this warranty, you must have paid the full contract price upon job completion, and produce the customer copy of this original contract and warranty.
